This week has been a living hell for me. To make a long story short...I was turning left at an intersection. There was NO ONE coming the opposite direction when I made my left turn. Mid-way to almost out of the turn I see headlights in my peripheral vision. No horn, no tires screeching...NOTHING just the impact. So this incident is considered my fault. My guess is the other driver pulled out of one of the side streets along that road (before you get to the intersection) and sped up to make the light (which turned yellow a second after I started making the left turn). I was given a ticket and the insurance/police found me at fault. So basically I'm getting F*CKED royally right now. I would prefer not to go into what else has been going on because it's just aggravating. So as of right now the car is settled safely at my parents house. Not sure what's going to happen to the car right now. Killer Tomato already donated the Red Top Optima battery to my Claret. Damage pictures below...

Just want to say thanks to everyone. Most likely I'll be getting the pearl Svx from my brother (formally Letitsnow's car) because he has realized it will be more practical to have a larger vehicle for work travels. Plus he knows how much I want a 5 spd.

I think you should talk to a lawyer about the accident. Maybe they can fight that finding.

I mean seriously, how are you at fault, she hit you...
So you turned left through an intersection, the other lady hits you on the rear passenger side, and its your fault!? She didn't notice the Bright red SVX in the intersection as she decided to drive through your car, and that's your fault? Insurance companies suck... Guess next time I want a new car, I should just smash into a car that is turning left through an intersection and blame them. |

in colorado you hit some one in the back - it's your fault. doesn't matter what you claim they or you did. it should be this way everywhere. obviously if you were in front of here (which you were judging by the damage) then it's her responsibility to not run into you. she needs to be prepared in case you slam on your brakes, the wheels fall off your car, whatever. the right of way goes to the vehicle that is in front. always.

I've been tempted to do that when someone jumps a light to make a left turn. Unfortunately I'm too concernared about the potential for an innocent kid hidden in the back seat.

i do that all the time. not trying to hit someone but put a little fear in them. might think twice after my k5 floors it at them and honks. the front end makes it apparent that i'm not bluffing.

In Conn. Generally if the hit is behind the rear door it is the person that hit you .If in the front of the front door it is your fault. Think a bout it . ......If you made it 3/4 past her she should have stopped in time . Fight it

Pretty much ALL left turn accidents in Utah are automatically the fault of the person turning left. (I've been in a few!) The last one I was in involved a brand-new $95,000 Porsche Carrera twin turbo cabrio that hit me as I was turning left out of a driveway into the street he was coming down the opposite direction. He was accelerating out of a red light about 1/2 block away (0-60 speed: 3.6 seconds...) it was night and I couldn't judge how fast he was coming. He was clearly speeding and actually passed me on the wrong side in oncoming traffic to try to avoid a collision. I had witnesses for my side, etc. but because I was turning left it was automatically my fault. The Porsche was totaled and had to be towed away, and I drove 10 miles home in my rusted-out Subaru Loyale with a bent-up front bumper being the only damage. Fortunately, my insurance covered the damages.

This ^. Generally Maryland is the same as far as automatic fault if someone hits you in the rear, but apparently this is wrong in this instance since I was hit in the side/rear. I pointed that out to the police and insurance that she clipped the the rear most part of my car. If she hadn't been on her phone, maybe she would have not been speeding and been able to at least tap her brakes enough to avoid hitting me. All the more reason I believe she was trying to make the light the second it turned yellow. I was treated like **** at the scene. Police barely spoke to me. They avoided me like the plague. And argued with my fiancé and insurance company about who was coming to tow the car. If I had known I would have had to personally pay for the towing and bull**** storage fees, I would have had the car towed to my work to sit until I could get my friends trailer to tow it home. Would have saved me about $400+ dollars. *sigh* It's been hell this last week. I can only say that I'm ok. Cars can be replaced/fixed. And hopefully I can fight the ticket. BTW I was given a ticket for negligent driving ($280). NOT "failure to yield to oncoming traffic while turning left." Im typing this from my phone so I can elaborate more later.

Any way you can post a picture or diagram of the intersection so we can see how it happened . I can't picture who was where etc.
