Get hit by someone with Farmers? Get a lawyer to do the talking to them!
They don't like to pay their bills and like to total vehicles that arn't totaled

Got the numbers, they will be happy to pay $2600 on a vehicle that would cost nearly $6000 to replace

I shop for the agent, not the company. If you don't have a good agent, you don't have squat and they won't do much for you.

( for the PITTANCE that I recieved). It is really HARD to get your insurance company to 'sue' themselves, so they can F&^%$# themselves instead! GET AN APPRAISEL!!!! It's your only HOPE!

I have a good agent, but it isn't his deal, repair estimate on the vehicle is $2500 and if they would repair it all would be fine, but that could go up a bit once work has started and if they total it then we cant go back after them for the remainder if they want to total it fine, pay market value!
As far as litigation goes, just sue the individual that caused the accident, paying damages is their responsibility, insurance is there to cover their butt and they choose cut rate insurance to save $$$, Farmers is notorious for this type of behavior.

Having perused this thread, I am doubly happy that I live in New Zealand, where insurance companies are held exactly to there policy terms as a result enforced of law.
Here, the insurance companies have a what they call a "knock for knock" agreement, whereby they each and all, accept their own liability in the case of a prang where both cars are insured. No argument regarding who was at fault. As a result, on average, they all win and the legal beavers are the losers.
