Post tow truck fuxors car, legal battle ensues

hi all

this is as much a record for me as a story for you.

so heres what happened.

LONG STORY SHORT
Great day snowboarding. going home....
I went off the road... Bummer. NO DAMAGE! WOOHOO!
...
but stuck in sand on side of road, steep incline. Lucky I didnt roll, yay . i didnt have my camera. Bummer.

someone called 911

while waiting, i witnessed about 150 near crashes that were caused by the reason i crashed: people STOPPING in the middle of traffic to RUBBERNECK! (i went off the road avoiding stopping/skidding SUVs, who were rubber neckin' at another fender bender.)

SO
the Cops promptly arrived 2 hours later, and another 30 mins the redneck truck driver shows... and no "single car accident" ticket.. WOOHOO!

so the tow truck driver gets his rig all set, and then, WRAPS THE CABLE AROUND THE FRONT PASSENGER WHEEL!!
i say HEY WAIT THERES TOW HOOKS
and the Highway Patrol yells
"GET IN THAT TOW TRUCK AND LET THE PROFESSIONALS DO THEIR JOB!!!"
(i could literally see the angry spittle flying about half of the ten foot gap between us)
man i wish i had my camera!

so i say to the driver... "any damage to my suspension or transmission and i will hold you fully liable" in the presence of The Law and another witness who was with me, in those words.
To which the redneck truckdriver said
"Whatever" sarcastically. i **** you not!

Then
I get back in the truck and watch in horror as they lift my baby all but the rear drivers tire OFF THE GROUND by the FRONT RIGHT WHEEL!
MAN I WISH I HAD MY CAMERA!

right as it reached the peak of the lift, the whole car drops about 5 inches with a horrible metal crunching sound. so i know that something broke. *COMPLETE SHOCK*

i get my car back, and drive away to a safer side of the road to give the tow trucker my info. like i said, the off the road experience did NO DAMAGE to my car... it was DEEP SAND and i just sunk.

so the guy hits me with the bill, and i refuse to pay, that he will hear from my lawyer. im f-ing PISSED . the cop was there and the tow truck driver was threatening impoundment, and the cop threatening tickets. i was cornered, i payed..... but i will get revenge.

That was last monday, February 20. 3:00 PM initial off the road time. ~6:00PM got out of there, tail between legs

flash to today... i had forgotten about the incident, no damage appeared, except that my car slighted left a little...

then today, POW! saw THIS:




Yup... its broke all right




Here's where it _used to_ hook up on the strut



its the stabilizer bar (name?) the thing that is (was) welded to the strut...
his tow cable ripped it off.
MOTHER FUDGER

so,
i will see his ass in court.
My PROOF:
i went to big o tires today, they gave me the slip saying it was broken.
lots of pictures (DAMN I WISH I HAD MY CAMERA WHEN IT HAPPENED!)
Lots of dealer price slips,
the fact i did not get a ticket at the scene, as proven by my
my clean driving record printout

I need a new strut, plus the 220 for the tow, and any labor plus court fees AND damages... i e me not being able to drive to school, not being able to pick up my little brother up from school, not being able to get to work, ETC

It is such an inconvenience
anyhoo, i hope you all liked my story.
any input or experience in small claims legal proceedings, please share

First off, after the cop said to get back in the tow truck I would have refused and came back with a smart ass remark then said either do it right or dont do it at all. And after the tow truck driver had that sarcastic remark I would have told him myself not to touch the car and that I would find another tow truck whose name wasnt Jethroe and then become a jackass. Im very picky about that kind of stuff. I'd rather spend acouple more hours on the side of the road then have my car damaged.

i agree completely, and had the officer already given me the ticket for "a single vehicle accident" i most definitely would have. but,.... that alone was keeping me quiet.

i didnt need that on my spotless record....
i was so mad...
but i will get mine... yes oh yes.

oh, i forgot
AND
i couldnt even use my AAA. he made me pay cash then get reimbursed later.

and this is not the first encounter with this tow co. **** em'.

i was attempting to call another tow co. but they didnt get there in time

Why whine about it? He shouldn't have run off the road in the first place, of course something is going to get broken. He's lucky it wasn't more.

This cannot be welded back. First of all it will be weak, and second in welding he will damage the inner rubber rings that keep the oil inside. Trust me, when doing my Struts mod, I faced this issue.

You need another strut and a wheel balance, and a new stabilizer if this one is damaged (I would assume that)

That whole situation for you totally sucks.

I have an idea!!

List the name of the tow company with a phone number and then we call then all day asking what there proper method is for pulling cars out of a ditch that have tow hooks. We could also ask then if they require a GED to be a tow truck drive?

Did you get the name of the drive? I feel the need to harass them in a big way. I hate ignorant people. Especially redneck owns that are still sucking on there Mother's bittys.

Get a Subaru dealership or good mechanic to give you a comprehensive, written estimate for restoring to car to "pre-tow" condition; if you can get them to state that the damage was apparently a consequence of the tow and not the accident, so much the better.

Now, the dilemma you face is, you've got a tow-truck driver whose competence would probably be backed-up by the police officer on the scene, should the matter come down to some legal proceeding. And to add insult to injury, you "owe" them $220. I mean, it certainly can't hurt to run this by an attorney (unless you're paying for the consult), but honestly, if you can present the repair estimate to the towing outfit, make legal action noises and persuade them to call it even, you'll be doing well. It's a no-win situation. Good luck.
