Re: Reckless driving, 84 in a 40..
I am with Ownbot, other than your subject heading referencing the 84 in the 40, I don't recall any mention of the citation in your narrative? What were you actually cited for? Are you objecting to the allegation that you were going 84 in a 40? If not, like another has said you are lucky you weren't arrested on the spot and having your license revoked.
You really are in a tough spot though. As for going to court, plead not guilty and you'll have your day and chance to express your side of the story, but then the judge will certainly consider your history. Worst case you get what the ticket fine suggests or the judge knocks it down a bit once he here's of your financial plight. Good luck though, and as hard as it may seem to imagine it's not the end of the world, just be a bit more careful out there! |

Well his computer wasnt working, maybe his radar gun wasnt correct either Sorry that this happened, but you just need to say your peace. Can you do defensive driving for those tickets to lower the price?

Re: Reckless driving, 84 in a 40..
I apologize in advance if this sounds harsh, but...
1. You admitted going over the speed limit. 2. I understand your previous situation with the guy getting out of his car with a blunt object. I had a similar situation years ago. Speeding to get away from someone, especially if they're chasing after you in the same amount of speed is one of the dumbest things you can do. Not only do you increase your chances of getting a ticket, but you also increase your chances of crashing or causing others to crash. 3. Honestly, you're screwed. When the judge looks at your previous record, they're going to assume it's some bogus story to get out of a ticket. Unless you have evidence to support your claims. The judge only has the observations of the police officer to go by. They hear so many insane stories everyday. The best thing (like the others said) is to try and get a lawyer. Maybe the lawyer can help you out. I apologize again if I sounded harsh. Sadly I had a speeding ticket early this year (my first one) and even with an solid explanation, the judge went by the observations of the officer because I had no evidence. The fact was that I was still speeding (and breaking the law), but the reason why didn't make any difference.

CN:
bad driver breaks law and angers others to the point of violence repeatedly, could lawyer possibly help to reduce punishment for accountability of actions?

Re: Reckless driving, 84 in a 40..
The justice system wants everyone to play by the books... and... hire a lawyer. The judge has no respect for you if you go in without a lawyer.
It definitely will help to get a lawyer. A Lawyer will know avenues to take to address the case that you could not possibly know to take in your behalf. Without a lawyer the judge will not even care what you say in court... no respect for you, ever, but the judge respects the lawyers. Keith |

Staying on topic, You're pretty much screwed and there is going to be almost no chance of getting out of this. Hiring a lawyer may be able to get the ticket and therefore fine reduced but not sure how much. |

Maybe you're not totally wrong.
It's trouble. Polices always win most of the times. It's trouble. Waste times. Do your best. Good luck.

Re: Reckless driving, 84 in a 40..
To augment my original post: I don't suppose it's ever a bad idea to have legal representation in court... the possible exception being traffic court.
A better play might be to consult an attorney on referral. Don't just throw a dart at a phone book and hope for the best. Pay for an hour of his or her time and see what they think of your chances. Then decide. And remember, all this advice you're soliciting online is worth what you're paying for it. (I'm not an attorney but I used to be married to one.) Georgia enacted some "super speeder" hyper-fine system awhile back. Don't recall the details, but I do know I've been minding my speed in well-patrolled areas. dcb |

Re: Reckless driving, 84 in a 40..
1) Slow down. There is NO REASON to drive that fast. You could have called 911 from your cell phone if you suspected someone following you.
2) At this point, I'd suggest seeing a lawyer. The situation does suck, and perhaps the law enforcement official was wrong about his behavior, but you did choose to break the law.

Re: Reckless driving, 84 in a 40..
Don't you have companies that employ former cops to go to court and fight it for you? Here in Toronto, we have lots of places like this, one is called Xcoppers, they go with you to court, if they don't win it for you, you pay nothing, if they get you off, you then pay them.
My son has used them with great success, there is a long standing "old boys" network with cops.

Re: Reckless driving, 84 in a 40..
Forget about getting a lawyer. You gonna lose another 400-500$.
Go to court alone ,wear a jacket and a tie. Apologize, don't deny speeding, apologize again. Don't try to tell to long story why you where speeding, but tell where you was going. Apologize again and ask for lower fine, offer to do some community work. That should help a little. Good luck. |

I know I was speeding and in my sate of mind at the time, I thought it was a good idea. I didn't call 911 or the local police because I didn't think to. I just thought enough to have my foot get really heavy until the person behind me was gone. Hopefully there isn't ever a next time for this to happen again.. Again, I really appreciate everyones help and honesty in this situation.

Re: Reckless driving, 84 in a 40..
He's an import. He was hired off the internet about 2 years ago.
The 'acting' chief he replaced is 2nd in command and a local guy. Way back when I was a student at that same college I hit 80 ib a 40 every morning at 7:50 am on that same piece of road!! (Without being chased)
