Legal advice...

Well last night on my way home from work i got pulled over for reckless driving. The officer said i was going over 100 which isn't true but either way they put me in cuffs and proceeded to search my car. I just wanted to check and make sure that there is nothing illegal or anything, that I might be able to get my charges dropped from. See upon searching my car he found ~1/4 gram of marijuana, and now I have a misdemeanor possesion charge as well. I plan on fighting the reckless driving but I've never been arrested before so I don't know if this is something I can even fight. Thanks for any and all help the advice will be greatly appreciated.

I'd call a lawyer. They maybe able to get you off. It's going to be hard to get off if they clocked you at 100mph. They can search your car if you get busted for reckless driving. If they randomly stop you for nothing, then technically they can't search you, but I'm sure they'll fabricate some reason to do it.

thats the thing he came up on me from behind, I had just got off my phone with my g/f and saw foglights barreling down on me so i sped up and was in the process of switching lanes to let what i thought was someone hauling @#%, soon as I accelerated to get over he was already pulling me over. No clocking was done and no speed is written anywhere on the ticket. All it says is reckless driving.

true but there are some very smart people here and people in the field of law enforcement and lawyers i would imagine. Im just trying to get a opinion on the subject.

Yeah, but isn't the DMV laws slightly different from state to state. I know that travelling in excess of 30mph in Georgia is considered reckless driving and they'll haul you in. The cops are required to explain what the reckless driving violation was on the ticket in GA I think. Like I said, I'd call a traffic lawyer in your county (or wherever you got the ticket) and ask them. Typically they'd tell you right off the bat if they can do anything about it. If they can, pay em. If they can't, pray to whichever god you believe in.

I remember my ex getting off going over 30mph in Florida, but she had to pay a lawyer like $150-$200. You don't want reckless driving on your record. Insurance companies may drop you for having that on your driving record.

i dont know the florida laws to well. but in maryland they cant surch your car without probably cause. driving fast isnot probable cause nor is reckless driving an arrestable offence(in my state). unless the pot was in plane site its a good chance you were subject to a unlawful search and possibly unlawfuly detained. did you give him concent to search your car did he lok in the glove box without your concent or the trunk without your concent where was the pot found?


definately get a lawer you could be forced to go to a drug treatment program (these cost around 200-250 a week depending on your insurence) a misdemenar can be a life changing charge dont take it litely.

In most states driving over a certin # of mph over the posted limit is an arrestable offence (iirc in OH it's 20 over). Given that it is an arrestable offence, the police would have the right to search the vehicle.
As already mentioned, instead of asking advice here, find yourself a lawyer, as motor vehicle laws vary from state to state

Well Wanta...you'll just have to be more careful. If your not rich see if you can obtain a public defender. Be prepared for your case to be possibly dragged out "continuances" while prosecutor decides severity of his or her case load. Try not to get freaked out by stress"good trick." And remember sooner or later the court needs to have your case settled. Sometimes prosecutor will offer plea bargain. But if possible get a lawyer...best of luck
