Angry Such bias always makes my blood boil.

My folks ran into a similar situation except it involved an Escalade (with their family owned company printed on the side) clipping his driver's side front while trying to squeeze through a single lane turn and trying to cut ahead on the left turn lane of a traffic light. I recall my parents complaining the driver was on the phone too. Their fender got cracked while the SUV got a few scratches on the corner of the bumper (which my mom snuck a picture of before the officer yelled at her to get back in the car). The officer told them to move the vehicles into a resteraunt parking lot and overall gave them the cold shoulder while he happily chatted away with the other driver.

A few weeks later, despite my dad drawing a diagram with a letter describing what happened the officer issued a report totally in favor of the Escalade driver where they described him somehow going around and jackknifed into her's. They also submitted a kneck injury claim on top of "structural damages" amounting to over a grand. Their insurance company capitulated and settled a plea out of court covering expenses all the while my folks had to pay for a new front fender out of pocket. Mind you my dad who was driving has an otherwise outstanding record and is able to count violations and accidents he has had on one hand. My mom also found out later through asking around that apparently the father and officer's kids played ball together. Goes show how human anyone can be.

I usually wouldn't go around telling this story but your's seems to also have the tall tell signs of cronism and/or bias inneptitude. There is plenty of corruption around so be careful but hopefully you get a judge that can offer you to plea down the negligent driving charges. Also, I know people here can be very supportive, for example after my accident I was able to pick up a driver's side door Eric had laying around that helped me save a chunk of change while giving me a leg up in negotiating a nice blended coat other dents to be repaired.

Sorry about the accident. Based on your description and diagram, instead of breaking or swerving to avoid an accident, she would rather be a participant. I sure hope she moves to a place where deer and other large animals can be found crossing the road so we can thin out the gene pool.

Update:

Went to court today. Plead not guilty to negligent driving. Of course the other driver was there as a witness. Annnndd of course she uses her children for sympathy. Going on what ages they are, etc. When I told my side of the story I said that I approached the car and she was on the phone. She said that after the accident she called her husband to pick up her kids. What bull. First of all I got to her vehicle as she was coming to a stop after getting out of the intersection. Two...why would you not call 911 first? Especially if you are soooo concerned about your kids. I wanted to punch her in the face and say "how dare you use your children like that!" But anyway, in redneck Carroll County it doesn't matter the situation or anything like that...if you're in a collision they will ticket you for negligent driving. Nevermind the fact it should have been for "failure to yield to oncoming traffic while turning left". Every cop I talked to said that my ticket was ridiculous. I was found guilty of negligent driving, but because of my clean driving record the fine was lowered and so were the points (only 1 point instead of 3).

So aside from having a totaled SVX sitting in my driveway and all of the other bad things that have happened to me lately...hopefully this is the end. Now I can put all of this behind me and move on to better things. As for the fate of Killer Tomato. I decided after selling only a few pieces that I will keep the car for myself. I still have my first SVX, a 92 Claret and I should have a 92 Pearly 5pd by spring. So I may need some parts anyway. So...that's all folks!

Wouldn't have happened like that in pa. Almost all rear end accidents i've seen they blamed the person who smash the rear of the other car.

I agree see post 41... A good body nan can fix it . How much $ is another story. We fixed up cars in much worse shape.

Not saying you are going to fix it , I just answered the first question "can we fix it " I said it could be. If it is a great car, great condition, no problems and you really want to keep it. BTW. I have seen some of the $500 cars ,,,,,,and your car looked pretty nice. If that was the car that is for sale in Greewitch NY "for your consideration " and you smashed it would you scrap it?
Well good news you get a 5 speed.
I guess no matter what I say I get cut to the quick. I will stand on the 1st amendment < LOL>

For some reason, I just saw this thread, been away for a while from the forum...
So sorry to know of the death of KT

Over here whenever you get hit from behind the driver door, it is automatically the fault of the other driver... well to a certain extent related to the traffic lights. In your case, it will be definitely 100% on the other driver

Well typically if you are directly rear ended (front of car into the rear end of other car) it is the fault of the driver who rear ended other driver. Because I was turning left and she hit me as oncoming traffic, it is considered my fault. Even though she hit the rear most part of my car (behind the rear wheel). There was no horn or screeching from her tires, so IMO she obviously wasn't paying attention to the road (due to phone or children or both) and DID NOT have control of her vehicle. I don't know how many times people have made a left turn in front of me and I was able to stop or swerve. I told my insurance company, police, judge about the phone and no one seems to care. Yet we have this new law that says that you can be ticketed for being on your phone. In the end, because of Carroll County's view of EVERY crash is automatically ticketed as "negligent driving" despite the nature of the crash. I got screwed and soccer mom gets to continue to talk on her phone while smacking her kids, putting on make-up, reading a book and drinking coffee.
