How much damage

national tire and battery F'd up... Heres what happened

They put new tires on the front of my car (yeah replace all at the same time, but my rears are actually very close to the 5/32s rule or whatever it is)
well, instead of putting the 225/50/16s that i purchased(225 is on the reciept) there are 245/50/16s on my car... definitly 1.3 inch difference in circumference...

i could tell something was wrong, but couldn't figure out what.. so i put it in FWD for the 330 or so miles it is from my house to school.. I then put it back in AWD and couldn't figure out what was causing the problems.. probably put about 100 miles on it like this (tried to drive as little as possible)... end result, i figure out what size the tires really are, now i'm trying to get in writing that if "the awd or transmission" fails within the next 6 months, that they will be liable for it... how likely, under the driving circumstances i described, will it be for my transfer clutch, or transmission to fail? just wondering whether i should REALLY push the issue of getting something in writing, or not.
