Stolen car back.....now what??

Got my car back....actually the police have it for fingerprints. Minor cosmetic damages, missing stereo etc. I don't know about the mechanical condition. I would not be suprised it there is clutch damage.

The police will have an address of where the car was parked all weekend, fingerprints and a trip permit that they forgot to remove from the window.

If they catch the theif, should I sue for damages? I know well that there is a very slim chance to get anything back but for me it is more about setting things straight. Watcha think?

forgot to add.....one of my students found it and phoned it in......pretty cool. It was only about half a mile from where I live.

in most cases the culprits would most likely be in a position to avoid getting caught, but the fact that they left a trip permit in the car makes me laugh. Your insurance company should replace and fix anything that has be removed/damaged. They will in turn sue the theives, if they feel like it.

On the other hand, if your insurance company doesn't cover you for theft or vandalism, then its up to you, I think small claims court would get you a judgement, but I dought a car theif is going to pay.
In preparation for whatever options you have:
Your best bet is to have YOUR mechanic review the damages, and provide a report. If you don't have a mechanic that works, or has worked, on your car recently, then you'll be out of luck for this. Take said report to your insurance broker/small claims court, and try to get restitution.

The police may also have some advice that you should listen to.

Congrats on getting your motor back, first and foremost, and I really hope any damage is minimal.


I respect your hunger for justice for the thief. You must temper this with the realisation that you left the car unattended, with the key in the ignition, and the engine running. If it gets to court, this will be a mitigating factor with any judge. So you need to balance this against the cost and difficulty of getting redress, and the likelihood of you or a court system being able to collect monetary compensation.

Me, I would take into account they left it a few blocks away for you to find. These guys did not want to hurt your car. Around here, they would burn it to a crisp to ensure no fingerprints or genetic evidence.

Your call, but I am pleased another SVX survives.

No excuse for car thief's. Beat'm to a pulp then beat 'm again!!! After you're done with that, maybe one more beating! Keys in the car,car running, door open, sign on car that says "Steal me!". I don't care...no excuse!

I've never had a car stolen, however, few things get me going more than theft. Get the little rat bastards and get them one at a time in a room to dispense a little ball bat justice and anger mismanagement!

Should anyone ever attempt to steal from me I'll either end up in jail or worse because my anger would run any common sense out of my head.

Well, I feel better now that the Meds have kicked in. How are you today?

I'm not excusing them. Just balancing the effort with the likelihood of monetary compensation.

You could chase it to hell and back through the courts, but little things like probation act, contributory negligence will come back to haunt you.

You guys used to string up rustlers for stealing horses? Thought you got over that phase by now.

I am no lawyer but I am AMAZED to hear that keys in the ignition running is even a factor. To me it is a black and white issue.


Bottom line is, he took my car.

You could very well be right, but it pains me to even think that a judge may think that way. It would take a pretty liberal judge though.

I don't think they gave a %$ about anything in my car. There was damage. The reason they dumped it so close is because they saw my students looking over the car just before they phoned it in. My students said that very shortly after they phoned it in the theives drove my car and another car off, and then returned in one car five minutes later.

I even know exactly where these guys live. So the current struggle I am facing is controlling the urge to retalliate. Really though I have a career and a family and I would never put those on the line to retalliate against some low-lifes.

Which brings me to the only way I have and that is through the courts. Whether I get money or not I am trying to decide if it is worth pursuing. Small claims court is a joke.....I have been through that one before.....

I am happy you got your car back and it wasn't wiped out or stripped down for parts that they wouldn't have been able to sell anyways.

The police may be able to tell you if there is anything else to do that would give you the results that you want.

As far as hanging horse theives, after doing that, they didn't steal any more horses did they?

I say persue it... If you get them now you may be preventing them from doing it again... Maybe not to you but to someone elses car. Punish them for their stupidity, before they do it again. Next time someone may not find thier car like you did.... Seek Justice!!!!! What is the civilian world comming to?!?!?!??!

if you know where they live...you could make things really difficult for them....ordering pizza for one...glueing their mail box shut...letting your dog crap on their lawn....endless possiblilites that can't be traced back to your hands....beeping your horn outside their house late at night so the neighbors complain and it wakes them up...

steal their wipers

just bring them to court. they took your car off your property (trespassing) they caused damage to it (vandelizing) they cause you a great deal of suffering from not knowing where your car was. they may have caused you to be late or miss a day of work...there are a lot of things you can take them to small claims for...i would...they also stole from you...if they wanted to feel the awesomness of the svx...at least they could have asked

i've been more partial to burning down their house with them sleeping in it. that would solve the problem. almost got car jacked once, i could tell by the way he eyeing me and walking up to the car. after facing a .45 as he approached, he decided it would be better not to jack me.
