The guy really did not know that he hit anything. I talked to the driver today. He says that the owner of the coffee shop should pay because he put the bike rack in middle of the road. Who in their right mind would put a bike rack in middle of the road, and who in their right mind would park their bike in a bike rack in middle of the road!!
Doesnt matter. I have claim started with their insurance company. I will know more on monday.

That wasn't the point. The bike rack should not be placed in the street, or what is actually refered to as the Traffic way, which extends to the sides of the lane of traffic past the shoulder or berm. And before someone starts crying, I did accident reconstruction before I got promoted to patrol supervisor. A bicycle is not a land vehicle, but a pedestrain convayence, allowed to use the traffic way, but not afforded some of the land vehicle propritary rights of way. I can't speak for Oregon, but a bike rack must be placed clear of the traffic way and on a sidewalk or private property. A bike may not be parked as a vehilce on a shoulder of a laned road or street. It doesn't forgive the truck driver for leaving, if he knew he hit it, but you may have a case against the shop owner. Look into your local regulations. Good luck.

Regarding the bicycle not being a Land Vehicle, this may be a state to state issue, in CA bicycles are generally considered to be vehicles in the law, ride with traffic VS walk against traffic, do not use cross walks, no right of way if ridden through a cross walk, but pedestrian right of way if walked through a cross walk, must stop at stop signs, not to be ridden on sidewalks, there is more, but that gives you the general idea. As for parking bicycles on the street I'm not sure how the law is written.

Kind of Karl. Bicycles must be ridden with the traffic, not against it. They must also be equipped with lights when ridden at night. They can't run red lights or stop signs. But they can't be parked like a car or motorcycle. That is the difference in land vehicle vs pedestrian convayence. There are more, but I was summerizing.

The bike rack was where the cars are parked. Regardless of where the bike was parked the driver ran over the bike proving that he was incompetant, impaired or not paying attention.
Who cares if the bike got ran over. It could have been a kid on the curb. You don't see that? The trucker was driving where no one should be driving. Here is a picture showing that this is a parking area.

Thanks for the nice shot of the 356's parked in a row.
A traffic way is the total width of the street, including shoulders and berms, and usually also 6 feet past that. A bicycle may not be parked on the shoulder like a car or motorcycle. A parking lot is off the traffic way, but open to through traffic and therefore some vehicle regulations pertain to actions on private lots. A land vehicle may use any or all of a traffic way, so long as it doesn't cross into oncoming traffic lanes or cause property damage. If the rear axle of the trailer stayed inside the curb line, I think you have and issue with the shop owner for having you park a passenger convaynce within the traffic way. But all my experience is in PA. Check your local laws. |
