Another Ebay warning:

General warning! I won a 97 blck svx, vin ending with 37, that was about 1/4 honestly described. A dozen omissions and misrepresentations on it on Ebay's ad so a heads up on it if someone sees it for sale in Maine.

I was told after the auction about the non working a/c but went to see it anyways (tix bought already). Major smoker damage, mismatched interior parts, torn and damaged interior parts, mileage discrepency, "minor" scratch was peeling back from "minor"rust, red paint around gaskets showing through new black paint, nice idle intermittant wobble -man this thing looked liek it was a t ground zero.

And the little bastid (soon to be known as "the defendant") is keeping my $1000. deposit for his trouble of driving it 100 miles for me to pick it up after we flew 250 miles and spent $500 on travel. I shoulda known better with a new ebayer...too much holiday trust. Just a red flag for those in the N.E.

That is too bad. I have found that there are just about the same number of bad ebayers as there are bad people in the general population. I have had some good luck and some bad too. I wish you could trust people at what they say. I don't know how they sleep at night. I hope you can get your money back, and at this point, it is more the principle than the money because it may cost that much to get it back.

Thanks, I'll be going for more than the deposit if he makes me come up there again, as nice as Maine is. I've bought/sold a dozen or more boats cars bikes on ebay in 6+ yrs and only had one other real big problem.

This guy said he talked ot a lawyer and ebay caht and they said to keep my $$ since I didn't buy the car. Knock knock-who's there? It's the Sheriff... you're served and you don't get a second helping...

Hmmm ... isn't that all called "buyer beware"?

A reputable dealer won't push for more then ~$100 to hold a car for a buyer. Depending on the state they're in determines laws governing refunds of deposits. Check out the statute of limitations aswell. Most states are 1 to 2 years. In NH, it doesn't matter what you signed or agreed to, if you don't buy it, you get your deposit back. In this case, sounds like you should check out the laws in both your state & in Maine, since you can likely file suit in whichever state works in your favor (IE: you can make him travel to you). If you file suit in your state, just hope he doesn't request a change of venue (as those are frequently granted).

My local small claims ct (next block up from our shop handily) says if they don't live in the same county, they won't file it.

Good idea to call ME small claims ct though for the laws governing car sales. and inowhere in the auction did it say "non-refundable" like most of them do. Yeah, I was a bit of a trusting schmuck. I wondah how a ME judge will like a yank like me.

well mines for sale for 2000 i remembered you asked me about it a while back when it was for sale for 4000 but since then the tranny busted so now its at 2000... ill make shure to let you know everything you want about it my moms starting to get pissed that its just sitting in the driveway

Jeff, I bid on a guitar on ebay and received emails from another bidder telling me that this was his friends guitar and that he purposely bid up the price after every other bid. I never paid for the guitar after this and now the pawn shop wants to take me to court because I left him bad feedback. Ebay is a joke.

Done over 280 ebays deals and only about 10 lemons, this being the worst. I may have Maine law on my side form I've read so far. lOve to toss hgis crawny ass in the clinker for a day or 2 to "correct" his attitude. Fat chance.

I've done close to 200 deals on ebay and only had one real problem...he's in jail now. Not just because of me...rarely do they screw over just one person...that wouldn't net enough cash to be worth it. So i just see if anyone else has been screwed, and offer the services of my cousin (lawyer) to them also.

That's how I roll (as my brother would say).
