Maryland Traffic Law ????s

Anyone out there an expert on Maryland traffic laws. I got pulled over on the way home from the Smokies for following a rig too closely. Now I know I'm guilty accoring to the law but when you're in a line of 15 cars all about the same distance apart ???? I asked the cop why he chose me and his response was "I can't pull everyone over". Now where is the fair and equal treatment in that? I really wanna fight this b/c it is total crap. The ticket doesn't even transfer I'm just really irritated about the whole thing. Plus it took 3 miles an hour off my time. I only came in at 68.4 for the trip home.

Well, since I was just in MD District traffic court fighting a questionable ticket,
I can pass along the observation that the judge that I watched didn't cut anyone any slack just because "everyone" was breaking the law and they just happened to be the one ticketed (what I watched was a guy trying to beat a speeding ticket on 95 - "everyone" was doing over 55, this guy decided to pass a state trooper who was pacing traffic . The judge didn't buy his point that "everyone was speeding, so why single him out").
I think your best bet would be to state that you were observing a safe following distance-if this was indeed the case-or plead guilty with an explanation (i.e., "I was just driving with traffic"). This would probably just get you the $25 "contribution" for court costs....

Just walk into court, light the ticket on fire, toss it on the floor and piss on it to put it out. Then try to leave. Really fast.

I'm sorry, but anyone that passed a Statie deserves a ticket for being just for being stupid, on top of the speeding ticket. That like the Golden Rule of the road, don't pass the fuzz. Who doesn't know that?

I'm leaning toward Freak's plan, sounds like the only way to beat it. Just make sure you bring a something to take care of those pesky guards, then tend to get a little annoyed with stuff like that.

do not follow more closely than reasonable and prudent having due regard FOR THE SPEED OF THE OTHER VEHICLE and of the TRAFFIC ON AND THE CONDITION OF the highway. 21-310, transportation article, annotated code of maryland, (emphasis added).

i would think the officer, at trial, must enter some testimony of the speed of the vehicles and/or the condition of the highway (ie, snow, wet, etc.) in order to sustain a conviction.

of course, what the judge had for breakfast can also be a factor.

I passed a cop the other day.

He was practially ON this guys bumper who was going like 10 under the speed limit. (think the guy had something to hide?)

I signalled for like 5 minutes, then switched lanes and passed him.

The funny part was, as i was coming up on him in the other lane, he decided he wanted to switch lanes too, and would have clipped my front bumper if i didnt honk at him to let him know i was there.

Hah, that was great, honking at a cop.

I passed him, and gave him a little wave, and he nodded and smiled.

Yeah sometimes you almost have to feel bad for the cops, everytime they get behined someone the person go's 5mph below the limit. It must drive them nuts, but then again if they didn't pull people over all the time they might at least do the speed limit.



I go at least 5mph over when they get behined me.

I dont know if its too late or not but most police have voice recorders along with the video... if he truely did say that you could ask that the tape be presented as evidence before the court, it may be a long shot... but who knows.
