Just got home from work & checked the mail .. Here's what i got
REFERENCE CASE #04-053897 The King County Sheriff's Office has responded to and investigated your original Hit & Run traffic accident, referenced in the above case report number. We are furnishing you with a computer printout of the Department of Licensing information listing the last known registered owner of the vehicle that was reportdly involved in the collision with your vehicle ( see attached ). If you wish to pursue this matter for the purposes of obtaining civil redress,we suggest you follow the appropriate option(s) listed below: 1. Contact your insurance company and ask them to handle the situation on your behalf ( Liablity only no under insured no good there ) 2. Contact the registered owner(s) of the other vehicle and ask them for there insurance informartion and /or for restitution ( please let him be insured ) 3. File a civil lawsuit for : a. Damages up to $ 2,000 in the District Court where the accident occurred. Attorneys are not allowed. b. Damages up to $ 10,000 in the District Court where the accident occurred. Attorneys are allowed to participate, and are advisable. c. Damages in excess of $10,000 in the Superior Court. Attorney participation is advusable. 4. If the damages are in excess of $ 500, you may send a copy of your accident report, plus a list of damages, to the Department of Licensing, Financial Responsibility Division, Olympia WA 98504, explaning that your vehicle was involved in a traffic accident and that the offending driver/registerd owner refuses to fufill their finacial obligation and compensate you for your actual damages. This may result in that person's operator's license and/or privilege to drive being suspended for up to three years ( pending your obtaining a civil judgment, at wich time the suspension continues untill judgment is satisfied, up to ten years maximum) This report must be filed within 180 days of the accident. We hope that one of these suggestions will assist you in recovering your damages. This Department will not be ivestigating this incident any further as the recovery of damages is a non-criminal matter.. This is what I have to go on ( just got off work & am mega busy till monday before I can do anything so any advice is appreciated. LIC/12074RS CO VIN/1FTDR15XXPP81061 VYR/1993 VMA/FORD.F150.2DR REG. What happened to the hit and run part! Aren't they going to go after them because of the crime that was comitted? They also told you to stop chasing him and let the officer handle it. OK, get to it!

You know... this looks like bull to me.... it was a criminal occurence because it was hit and run.
Seems that you have no redress but what your insurance company would like to pursue. Let's hope that it's a lot. Based upon my own experience... that's $500 damage or more. Ridiculous but true. ~~Michelle

I'd go and complain to the KC sheriff's office in person, then go to the news (doesn't king 5 have a phone number for news tips?) and complain that our local law enforcement refuses to prosecute hit and run. The dumb thing is, if you know that you're at fault, there's no reason not to run--you might get away, and if you don't the worst that happens is that you're stuck with the bill, same as if you'd stayed put and exchanged info like a normal person. It certainly sounds newsworthy.

Before jumping to any conclusions....maybe one of our members lives close enough to this guy to snap a few pictures of him (and his truck) and then send it to you to verify he was actually the a**hole who was driving.
And if he was.....hang him by his nuts! Good Luck and sorry about that.

LET'S ALL GET 'IM!!!!!!!
I think some pic's of his vehicle would make for good evidence towards prosecuting and suing the ba$tard. If you know he's home, have the local sheriff/police meet you there and confront him. -Mark Last edited by mark10t; 02-28-2004 at 07:48 AM. |

Ya know, you might just call the guy and let him know what's going on. If his family members or friends answer the phone, don't give details, just tell them you're calling regarding a hit-and-run by a [whatever his truck was], license plate number [insert that here] and ask when the registered owner will be available so you can call back later. (Don't ask him to call you.) When you do get in touch with him, tell him to contact his insurance company and report the accident. (Imply that he might get off the hook for hit-and-run if he does this before the law officer finds him even though he may not.) Let him know that you're ready to start a legal proceeding and give him one business day to get the insurance process started. Make sure he provides proof that this process has begun, and VERIFY the proof. (Name of insurance company and policy number. Call them yourself.) If he claims not to, or does not have insurance, ask him if he'd like to settle out of court. Explain why it would suck if he went to court. (A legal history of a judgement against him which hurts his credit, a long trip from Colorado to a Seattle court, almost certain judgement against him (even if he wasn't driving, the registered owner is legally liable), and court costs and other expenses in addition to the repair cost established in the judgement.)
It's quite likely this will work unless he's just flat broke or you can't contact him. Do not accept payments, and do not delay or give him too much time. You might also call the Colorado State Patrol and Sheriff’s office in his county and give them the case reference number. You may be able to have a lawyer make these calls for you for a very reasonable fee. (They have a way of being persuasive.) Throughout this entire process, ASK FOR NAMES AND NUMBERS. Write everything down. Whoever answers the phone, get their name. If so-and-so isn't there, ask if there's a number you can contact them at. Be persistent. Write down the date and time of any contact you have with anyone. This can and probably will pay off handsomely. Keep detailed notes - you may need them in court. If a judge sees that you tried to be nice, you will be strongly favored in any judgement. Also, call your Sheriff's office. They may be still be working on this. There may be a warrant out for the guy. If there isn't, find out why not. (If there is, use it against him.) Get a copy of the report if it's complete. You may need to know who the witnesses are if there are any. Details in the report may help you or work against you. They may also give you new ideas about how to go after this guy. I had friend get his vehicle stolen from him. The guy who swiped it had an old title because he had previously filed for lost title. The crook showed the title to a tow company, claimed he just lost the key, and had it towed home. Anyway, somebody witnessed the tow truck haul the vehicle away so my friend called the tow company. Normally the tow company would never give away this information, but they suspected something was up so they gave him the name and number of the guy who called for the tow. My friend called the guy, told him that he filed a report with the Sheriff, and the guy freaked out - told him he made a mistake, and said my friend could come and get his vehicle. That was it. Just like that. Easy, huh? You may not get that lucky, but it's been known to happen. The guy may just cut you a check and cut his losses hoping to avoid a criminal offense. Try it. Good luck.
