any claim adjusters

I hit the wall yesterday, due to a guy that cut me off real bad, my back lost control and I went sideways. now I didnt make a report yet, because 1 i didnt hit his car, 2, i heard that supposedly the insurance will say that no matter what im supposed to be in control and 3 i dont want to have a accident on my license if im not going to win this claim. any advice?
