Another reason to hate FORD
Subject: Utterly unbelievable
I sure hope this is resolved in the owner's favor. I can't see Subaru doing this with the SVX calendar and cannot believe this could POSSIBLY stand up in court. What about all the images of Fords in magazines? For those of you who don't think that all this "Intellectual Property" stuff has gotten completely out of control, and is all just pirates wanting everything for free, I offer the following evidence that corporate America is utterly out of control. http://www.bmcforums.com/showthread.php?t=42402 Skip to post #42... __________________________________________________ ________________________________ I got some more info from the folks at cafepress and according to them, a law firm representing Ford contacted them saying that our calendar pics (and our club's event logos - anything with one of our cars in it) infringes on Ford's trademarks which include the use of images of THEIR vehicles. Also, Ford claims that all the images, logos and designs OUR graphics team made for the BMC events using Danni are theirs as well. Funny, I thought Danni's title had my name on it ... and I thought you guys owned your cars ... and, well ... I'm not even going to get into how wrong and unfair I feel this whole thing is as I'd be typing for hours, but I wholeheartedly echo everything you guys have been saying all afternoon. I'm not letting this go unaddressed and I'll keep you guys posted as I get to work on this. I'm sorry, but at this point we will not be producing the 2008 BMC Calendar, featuring our 2007 Members of the Month, solely due to Ford Motor Company's claim that THEY own all rights to the photos YOU take of YOUR car. I hope to resolve this soon, and be able to provide the calendar and other BMC merchandise that you guys want and deserve! This thread will remain open for you to comment however you wish, and I'll update it as needed. __________________________________________________ ________________________________ This is a fan organization who are publishing a calendar of pictures THEY TOOK OF CARS THEY OWN. Ford handed them a Cease and Desist, saying that car owners are not the owners of their own images of their own cars. I can't believe this. They own the rights to my pictures of my car? I know that I own a Subaru, and not a Ford, but it is the same thing. When will this stop and how far will it go?

Don't count on it... North Ursalia was issued a C&D for his <Ravensblade-Impreza.com >.
This is disturbing, because North Ursalia's site is clearly not related to Fuji Heavy outside of its appreciation of their products. If Ford is making Mustang hoodies, and cafepress is printing them for a club, then there's a competition thing. More than anything, it has to do with whether something is meant to be a knockoff, asking me. Using the image of a Mustang with "Central Iowa Mustang Crew" printed around it shouldn't really be a problem with Ford, unless they don't like Iowa. What of discontinued and out of stock merchandise? If I want a copy of some obscure band's CD that my buddy loaned me, if I can't snag it in a store, on Amazon, or on eBay, is it such a violation to copy it? I'm not pushing for full advocacy of piracy and copyright violation, but there has to be a limit! Waaaaaaaaay off topic. Ah, well. P.S.: It should indicate at least one hoodie and one calendar sold to NY.

My calendars are still up...so they haven't put them on hold yet....(might be a good time to get one if you want one)
I have had them veto some of my images before since I started my shops a few years ago....usually because I had the word "Subau" in it...so I try to omit that from anything I put in the shop. But the fact that the SVX and the XT have beem out of producion for over 10 years, may keep us from getting the same treatment...but may not

You might be right in thinking that Huck, at least I would hope so.
I believe it was mentioned before that Subaru no longer owns the copyright to the word "SVX" or even the SVX "logo", which is used right here in the Network logo, among other places like some of your merchandise. They may not have a leg to stand on even if they did care to pursue something. The thing about Ford not letting them even use pictures they took themselves is crazy though!
