I don't think the insurance company is going to have much of a choice, and I think that maybe the guy will just pay you cash if you dont press charges against him. I would try to work that angle first, if that doesnt work, have the insurance company come take a look at the car. Tell them you had to start selling the parts because you had no car, and no money. I think you might be able to get more money out of them if you get them for time lost from work, inconvenience, etc.
