new caliper installed, new brake noise

I had to have my front right caliper replaced basically because it froze to the rotor. I found this all out while replacing my pads a few weeks ago, while driving with the new pads the right began to smell and the area became really hot. I took it to tires plus for an inspection and my speculation was correct it was the caliper so 249 dollars later I get my car back. No more frozen caliper but now I hear a grinding noise. Now matter if I apply the brake or not, although it does get louder when I do use the brakes. Here are the things that pop in my head. The pads are new and are still rather close to the rotor and the guy at tires plus said that the rotors were getting close to needing replaced but he says it wasnt needed just yet. Also the rotors weren't the smoothest. But this shouldnt matter as it still does it when the brakes aren't/shouldn't be touching the rotors. Whats the deal.
