In most 4wd systems, the transfer case is not computer monitored. Therefore, the ECM has no idea whether it's in 4wd, 2wd, hamster wheel drive, or anything for that matter.
The new electronic systems could be different, I know for a fact that GM's servo-driven system does not have a speed limit (personal experience). I can't speak for other brands though.
