The founding fathers had lived through a regime where the ability to speak out against the ruling legislative body was prohibited. The concept and voice of an opposition to an oppressive regime was repressed.
So they enshrined the right in your new constitution to speak out against the ruling party/regime as a foil against manipulative governmental bodies. They called this right "free speech".
It was never meant to be the ability to say what you like when you like against another individual.
The "right to bear arms" is another phrase in your constitution that is freely misinterpreted, disregarding the rationale and use of militia before your Civil War.
